FAQs

  • The Parole Board of Canada has exclusive jurisdiction to grant, refuse or revoke a Pardon/Record Suspension.

  • You may apply for a Record Suspension if you:

    • were convicted of an offence in Canada under a federal act or regulation of Canada as an adult; and/or

    • were convicted of a crime in another country and were transferred to Canada while serving that sentence under the Transfer of Offenders Act or International Transfer of Offenders Act.

    To apply for a Record Suspension, you must have completed all of your sentences, which include:

    • all fines, surcharges, costs, restitution, and compensation orders;

    • all sentences of imprisonment, conditional sentences, including parole and statutory release;

    • any probation order(s).

    You DO NOT need to apply for a Record Suspension if you:

    • have only received an absolute or conditional discharge*; or

    • were only convicted in a youth court or youth justice court

  • If you have a criminal record, you will need a U.S. Entry Waiver. However, this is not exclusive to those who do not have a criminal record but have reason to believe that they will be denied entry into the U.S. denial

    • If you’ve been released with an Absolute or Condition Discharge, including dismissed, withdrawn, or stayed charges

    • If you were charged with a DUI

    • If you have overstayed your welcome in the U.S.

    • If you have worked illegally in the U.S.

    • If you have been deported from the U.S.

  • Upon submission, a U.S. Entry Waiver typically takes about 10 to 18 months for a definitive answer.

  • A NEXUS card speeds up border crossing between the US and Canada, reduces wait times, and provides access to dedicated processing lanes at land border crossings, Global Entry kiosks when entering the US, and NEXUS kiosks when entering Canada.
